How the Oregon Public Records Law works

Oregon's Public Records Law (ORS Chapter 192) provides any person with the right to inspect and copy public records of all public bodies in the state, covering state agencies, counties, cities, school districts, and other governmental bodies across all three branches of government with limited exceptions. Oregon is notable for the existence of a Public Records Advocate, an independent officer who helps requesters navigate the process and mediates disputes between requesters and agencies before litigation.

Agencies must acknowledge a request within five business days and must either provide the records or explain the basis for withholding within a reasonable time. Fee waivers are available for requests that primarily benefit the general public. The Public Records Advocate may mediate disputes; requesters unsatisfied with the outcome may seek judicial review in circuit court, where attorney's fees may be awarded. Common exemptions include personnel records, attorney-client communications, trade secrets, and certain law enforcement investigative records.
