How the Nebraska Public Records Law works
Nebraska's Public Records Law (Neb. Rev. Stat. § 84-712 et seq.) provides any person the right to inspect and copy public records of state and local governmental bodies, including state agencies, counties, municipalities, school districts, and other political subdivisions. The law is grounded in a clear presumption of openness, and the burden falls on agencies to justify any withholding. Nebraska does not require requesters to provide a reason for their request, and the law does not specify a mandatory response deadline, expecting agencies to respond without undue delay.
Fees for reproduction are allowed at a reasonable rate. The Nebraska Attorney General's office provides informal guidance and may issue advisory opinions, but formal enforcement is through district court proceedings. Courts may award attorney's fees to prevailing requesters. Common exemptions include personnel records, trade secrets, attorney-client communications, and certain law enforcement investigative files.
