How the Montana Public Records Act works
Montana's Public Records Act (Mont. Code Ann. § 2-6-101 et seq.) is grounded in the Montana Constitution, which declares that no person shall be deprived of the right to examine public documents, giving access claims additional constitutional weight beyond the statute. Any person may request records of any state or local government entity, with no residency requirement. Montana's law does not specify a statutory response deadline, relying instead on a judicial "reasonable time" standard.
Fees may be charged for the cost of reproduction. Montana does not have a dedicated administrative body for resolving public records disputes; enforcement is through district court proceedings. Courts may award attorney's fees to a requester who demonstrates an agency unreasonably withheld records. Common exemptions include personnel records, attorney-client privileged materials, and records specifically protected under other Montana statutes. The constitutional foundation makes Montana courts generally receptive to access claims.
