How the Massachusetts Public Records Law works

Massachusetts's Public Records Law (G.L. c. 66, § 10), substantially reformed in 2016, provides any person with the right to inspect and copy public records of state and local agencies. The 2016 reforms added clearer timelines, stricter fee provisions, and stronger enforcement mechanisms to what had been a historically weak regime. State agencies must respond within 10 business days; municipalities have 15 business days. Extensions are available for complex requests.

The 2016 reform is notable for tightly controlling fees: the first four hours of search time are free, and copies are capped at $0.05 per page. The Supervisor of Records within the Secretary of State's office hears appeals administratively, and requesters may also pursue relief in superior court, where judges may award attorney's fees and impose sanctions for unreasonable denials. Common exemptions include personnel records, attorney-client communications, and preliminary drafts or deliberative materials.
