How the Connecticut Freedom of Information Act works

Connecticut's Freedom of Information Act (C.G.S. § 1-200 et seq.) is distinguished by the Freedom of Information Commission (FOIC), an independent state agency that hears and adjudicates public records complaints without requiring requesters to go to court, one of the most robust enforcement mechanisms of any state. The FOIA covers all branches of state government and applies to municipalities, boards, commissions, and any public agency. Any person may file a request, and agencies must acknowledge within four business days.

Noncompliant officials may be subject to fines up to $1,000 and civil contempt proceedings. Common exemptions include personnel records, preliminary drafts, attorney-client communications, and trade secrets. Decisions of the FOIC may be appealed to superior court. Connecticut's administrative enforcement model significantly reduces the cost and complexity of asserting access rights.
