How the Delaware Freedom of Information Act works
Delaware's Freedom of Information Act (29 Del. C. § 10001 et seq.) grants citizens of the state, Delaware ties access rights to residency, the right to inspect public records of state and local agencies. The law covers all executive branch agencies, counties, municipalities, and school boards, but notably exempts the General Assembly and the judiciary in most circumstances. Agencies must respond within 15 business days of receiving a request.
If production cannot be completed within that window, the agency must notify the requester with a reasonable timetable. Fees may be charged for reproduction, and the law allows agencies to charge for staff time on complex requests. The Delaware Attorney General handles disputes and may issue mediation decisions; judicial review is available in the Court of Chancery. Common exemptions include personnel records, attorney-client communications, and trade secrets.
