How the Louisiana Public Records Act works
Louisiana's Public Records Act (La. R.S. 44:1 et seq.) provides the right to inspect, copy, and reproduce public records of all state and local agencies to any person. The law's protections are rooted not only in statute but in the Louisiana Constitution, which declares that no person shall be denied the right to examine public documents, giving open records claims additional constitutional weight. The law covers all branches of state government as well as all local government entities.
Louisiana requires agencies to respond "immediately" when a request is made in person, and in writing within three business days for written requests. Fees are permitted for the actual cost of reproduction. Disputes are generally litigated in district court, where courts have broad authority to order disclosure and award attorney's fees to successful requesters. Common exemptions include medical records, attorney-client communications, personnel evaluations, and trade secrets.
