How the Alaska Public Records Act works
Alaska's Public Records Act (AS 40.25.100 to 220) guarantees that every person has the right to inspect and copy public records of the state. The Act covers all state and local government bodies, and allows any person, not just residents, to make a request. Agencies must respond promptly and provide a timeline for production if records cannot be immediately delivered. Fees may be charged for the actual cost of reproducing records but not for inspection.
Notable exemptions include medical records, attorney-client communications, personnel files, and trade secrets. Alaska does not have a dedicated oversight body for public records disputes; if a request is denied, the requester must file a lawsuit in superior court. Courts evaluate the reasonableness of both the denial and any associated fees.
